Title Insurance offers protection against real estate title defects in the form of an insurance policy issued where the insurer agrees to reimburse loss or damage resulting from an undiscovered defect in title to an owner, lessee or mortgagee. The Insurance is provided by NEM Jamaica Limited with support services by Caribbean Title for Jamaica citizens.
Mortgage Purchase
In this case the Lender’s Title Insurance Policy is applicable and the Owner’s Policy is optional.
- The offer to purchase should include a ‘Subject to Title Insurance’ requirement with a stipulation of closing within 30 days of a stamped Sales Agreement.
- The purchaser/mortgagee complete a Request for Title Insurance form (apply for Lender’s Policy).
- Submit the form to the mortgage institution when applying for mortgage.
- The lender will include the cost of the title insurance in the closing cost.
Cash Purchase
In this case the Owner’s Title Insurance Policy is applicable.
- The offer to purchase should include a ‘Subject to Title Insurance’ requirement with a stipulation of closing within 30 days of a stamped Sales Agreement.
- Include in the Agreement of Sale the costs for Title Insurance which is payable upon signing of the agreement.
- Have the purchaser complete a Request for Title Insurance form (apply for Owner’s Policy). Sales Associate will submit to Caribbean Title.
